Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.


Purchases

You are encouraged to familiarise yourself with your rights contained within the Sale of Goods Act 1979, Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contracts Regulations 1999.

If you wish to purchase any product or service made available through the Service ("Purchase"),you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment methods in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. You expressly agree that Trinity Farm is not responsible for any loss or damage arising from the submission of false or inaccurate information.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

Our Service may contain links to third-party websites or services that are not owned or controlled by Trinity Farm.

Trinity Farm has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Trinity Farm shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.


Termination

A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.


Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the service.

Packing Policy

Trinity Farm publishes the anticipated contents of the box scheme each week on the website. We would only change these items due to unavailability or unsuitability. We reserve the right to change any of these products prior to packing without informing customers.

If customers have asked for replacements to be made, Trinity Farm will honour these instructions as much as possible, however, there may be circumstances where this is not possible. Customers must notify Trinity Farm if there are any allergies that need to be considered when packing.

All boxes under the Box Scheme are packed the day before delivery therefore any changes to instructions must be sent to orders@trinityfarm.co.uk at least 48 hours before the delivery is due. Trinity Farm cannot guarantee to honour any new instructions or requirements if sent within 48 hours of the delivery time.

At the time of packing, Trinity Farm will inspect all items to ensure that they are of good quality. Due to all products being organic and therefore not subjected to chemical, preservatives or waxing techniques. Please refer to the Returns & Refunds Policy for when the produce received is inedible.

Trinity Farm will reduce the amount of plastic being used in the box scheme as much as possible and use biodegradable and paper bags where it will not damage or shorten the lifespan of the produce. Plastic will be used where there is no alternative in order to provide the best quality produce.


Delivery Policy

We will make delivery to your address as stated when you set up an account or update that address. We reserve the right not to deliver to all locations and we will tell you when you apply to register an account with us whether we can deliver to your address. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions. In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability, and will offer compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal.

We endeavour to keep your delivery day the same, but we reserve the right to change it temporarily or permanently and will tell you if we do so.

Trinity Farm will send out an email notification of when your delivery is expected together with a tracking link. If there is no answer when we come to deliver, and no instructions on where to leave the delivery, we will leave the delivery at the front door or in a shaded area if available. 

If we are unable to deliver to you or have to deliver late, for reasons beyond our control, for example, adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept liability for any inconvenience or loss that this causes. We will not, of course, charge for Products unless or until we have delivered them to you.

Where we agree with you that we will hold a key to your premises and make delivery of the products to a place within those premises by using the key, the following terms shall apply:

  • we will use our reasonable endeavours to ensure that we hold the keys securely;
  • we will use our reasonable endeavours to ensure that the products are delivered to a place within the premises that you and we have agreed;
  • save in respect of losses, damages or costs caused by our negligence in relation to our holding and use of your keys (for which we shall be liable to you for all such losses, damages and costs that were foreseeable by you and us at the time we entered into the contract for the supply of the products), we shall not be liable to you for any losses, damages or costs (whether in contract or tort) arising from our holding and use of your keys;

You must inspect the Products as soon as possible after delivery and notify us promptly if you find any defects, by calling us, emailing us or writing to us at the telephone number or address shown on our Website. We will replace or refund you for defective Products.

We will not charge you for Products which we have not delivered in accordance with these Terms and Conditions.

By signing these Terms & Conditions, customers understand that they need to give their fruit & veg a good wash before eating.

Trinity Farm will collect and reuse any old boxes if they are left outside on the day of delivery. 


Cancellation & Pause Policy

If you wish to terminate an accepted order, we require 5 working days to process your cancellation. If the next delivery date falls within the 5 working days, you will still receive this order but it will be the last one under your order number. You will also be liable for the cost of the order and the delivery charge for the last delivery of your order. 

A "working day" is classed as Monday to Friday; Saturday and Sunday are not classed as working days.

Customers wishing to cancel an order must do so in writing and can email cancellation requests to orders@trinityfarm.co.uk.

Alternatively, customers can pause their delivery at any time, but they must give at least 48 hours' notice for non-fresh produce and 5 working days for fresh produce. If notice is given within 48 hours/ 5 working dates of the day of their delivery, refunds or credit cannot be offered as the produce will have been ordered/harvested ready for packing. 

If at least 48 hours' notice has been given, Trinity Farm will pause both the order and the standing order. When customers are ready to reinstate their order, they can do this through their account, which will restart any payments.


Returns & Refund Policy 

Customers should be aware that organic fresh produce can vary in size and weight. Trinity Farm will deliver produce that best meets the weight specification.

Only products that are in tins or packets, not fresh (vegetables, herbs and fruit, dairy and bread) can be returned. Fresh products cannot be returned.

Eligible products can be returned within 7 days of the original purchase of the product.

Before you return a product, please make sure that:

  • The product was purchased in the last 7 days - proof of purchase or delivery must be provided
  • The product is in its original packaging

Damaged or Defect Fresh Items

All of the Trinity Farm box schemes are classed as 1 product, therefore if you receive a damaged or defected fresh product, please take a picture and send it through to orders@trinityfarm.co.uk. If the produce is clearly damaged or inedible we will offer a free portion of the produce. Fresh products can only be refunded at the discretion of management. Trinity Farm will not refund or replace the entire box.
